Marital Property
Texas recognizes two types of property: community property and separate property. Property acquired during a marriage is presumed to be community property and property acquired prior to marriage is presumed to be separate property. However, all property owned at the time of a divorce filing is presumed to be community property and a person wishing to claim property as separate property must prove it as such.
